Australia - Northern Territory

Overview

The Northern Territory (NT) is Australia's unique jurisdiction, where most of the country's licensed online bookmakers are concentrated.
The Northern Territory Racing Commission (NTRC) is the de facto national regulator of online wagering, as NT-issued licences are valid across Australia (subject to federal regulations Interactive Gambling Act 2001 and the NCPF/BetStop national framework).
NT mode provides flexibility, manufacturability and strict control over responsible gambling, while remaining a competitive platform for large operators.

Legal and regulatory framework

Regulator: Northern Territory Racing Commission (NTRC) is an independent body under the Department of Industry, Tourism and Trade (DITT).

Main acts:
  • Racing and Betting Act 1983 is the legal basis for licensing betting and betting.
  • Gaming Control Act 1993 - regulation of casinos, slot machines and online admissions.
  • Interactive Gambling Act 2001 (federal) - determines which online services are allowed/prohibited in Australia (in-play - phone only, casino/poker - prohibited).

NTRC licenses wagering & sports bookmaking, betting exchange (Betfair) and bookmaker's key employee. Decisions of the commission are made at regular meetings, and licensed operators are required to have a registered office and AML/CTF system in Australia.

Online wagering and the national role of NT

The Northern Territory has become the core of the Australian online marketplace as:

1. NTRC licenses are recognized by all states, subject to PoCT payment in the customer's respective region.

2. The modernized regulation provides fast alignments and clear AML/CTF procedures.

3. The country's largest operators (all legal brands except TAB) are licensed in NT.

Licensed service types

Fixed-odds and tote betting on sports, horse racing, virtual events.
Betting exchange (Betfair) - permitted form of peer-to-peer bets.
Telephone in-play betting - allowed with voice betting (as opposed to online in-play).
Fantasy and novelty betting - allowed in agreement with NTRC.

Forbidden

Online casinos, poker, slots and bingo (federal IGA).
Acceptance of bets on lottery outcomes.
Advertising or "inductions" without NTRC permission and code compliance.

Point of Consumption Tax (PoCT)

Rate: 15 per cent of net wagering revenue on Northern Territory customers.
Threshold: Exemption to A $150,000.
Administration: Office of Territory Revenue (Treasury and Finance).
Function: provides equal fiscal contribution to NT-registered operators when serving customers across the country.

Responsible play and compliance

The NTRC applies a "Responsible Wagering Code of Practice" policy including:
  • mandatory tools of self-exclusion and limits;
  • a requirement to offer access to BetStop's national registry;
  • ban on credit rates (from June 2024 - including cryptocurrency and credit products);
  • strict AML/CTF procedures (in coordination with AUSTRAC);
  • аудит annual RG reports и compliance certification.

Casino and offline sector

NT has a single casino, the Mindil Beach Casino Resort (Darwin), licensed under the Gaming Control Act 1993.
The pre-existing Alice Springs casino ceased operations in the 2020s.
EGMs are only allowed in licensed clubs/casinos, overseen by DITT and TLGC.

Advertising and Inductions

Advertising and promo: controlled by NTRC; there is a direct ban on inducements ("open an account bonus" and similar promotions).
All marketing materials must be approved under the Wagering Code and comply with the federal NCPF.
Violations are punishable by license suspension or fines.

Enforcement and cases

The NTRC actively publishes reports on:
  • warnings and disciplinary sanctions;
  • public hearings on AML and advertising violations;
  • statistics of player complaints.
  • Operators are required to notify the NTRC within 14 days of all RG incidents, complaints and payment delays.

2. PoCT 15%: NT customer reporting, meeting A $150,000 threshold.

Perspective (2025-2027)

The Northern Territory will retain the role of the regulatory core of Australian online gambling:

  • transition to uniform NCPF auditing standards.
