Platform Terms of Use

1) Purpose of the document and coverage

Terms of Use (ToU) - a public offer/accession agreement governing the relationship between the operator and the user: access to the site/application, creating and maintaining an account, participating in games and bets, processing payments/bonuses, marketing, dispute resolution.
Scope: web, mobile apps, mirrors/subdomains, white-label/skin brands, APIs/widgets.

2) Recommended structure of ToU (skeleton of sections)

1. Definitions and interpretations (terms, priority of documents).
2. Acceptance of conditions (age, residency, agreement with politicians).
3. Account (registration, verification, multi-accounts, security).
4. KYC/AML/Sanctions (sources of verification, freezing during verification).
5. Deposits, rates, calculations and conclusions (currency, fees, terms, limits).
6. Bonuses and promos (wagering conditions, priority of rules, restrictions).
7. Honesty of games (RNG/RTP, "palpable errors," cancellation of markets).

4) Key provisions and sample wording

4. 1 Acceptance and age

Consent: registration/login/tick + explicit confirmation of age (18 +/21 +).
Geo: access prohibited in prohibited jurisdictions; geo-block and location checks are applied.

Template:
  • "By clicking Create Account, you acknowledge that you are [minimum age], are not in a prohibited jurisdiction, and agree to the Terms, Privacy Policy, and the Responsible Gaming Rules."

4. 2 Account: registration, security, multi-accounts

One user - one account; joint/corporate prohibited.
The user must keep the password secret; the operator can request 2FA.
The operator has the right to temporarily freeze the account during verification.

4. 3 KYC/AML/Sanctions

Right to request documents/selfies/proof of address, source of funds (SoF/SoW).
POP/sanction screening; in case of coincidence - block and notification by law.
Freezing of transactions during the inspection period; cancellation of bonuses for fraud is possible.

4. 4 Payments: Deposits and conclusions

List of supported methods, fees (if any), currencies and rates.
Same-method rule and return to the source; withdrawal limits and deadlines, KYC before withdrawal.
Handling of returns/chargeback and right to withhold investigation fees/expenses.

4. 5 Bonuses/Promotions

Wager, deadlines, game tolerances, maximum bets under the wager, regions.
Prohibition of "bonus abuse" (low risk/double account/overflow strategies).
Priority of Bonus T&C over general ToU in terms of a specific promotion.

4. 6 Fair play, mistakes, cancelling markets

RNG certification and RTP control; link to the Fair Play section.
Palpable error: the right to correct/cancel the calculation in case of an obvious feed/line error.
Cancellation of the market/match → return of the bet (void) according to the rules of bets.

4. 7 Behavioral limitations

Prohibited: bots/scripts/agents, multi-accounts, sharing accounts, disguised VPN/proxy for bypassing geo, collusion, arbitration in violation of the rules, chargeback fraud.
The right to withhold payments/close an account in case of a proven violation with magazines.

4. 8 Responsible play

Self-monitoring center: deposit/loss/time limits, timeout, self-exclusion; suppression marketing for a period of limitations.
Interaction with registries, if applicable.

4. 9 Dormant accounts and closure

Criterion of inactivity (for example, 12 months), notifications, possible reasonable service commission (if allowed by law), rules for handling funds (attempt to return, then by law - to the fund/government agency).
Voluntary account closure: order and consequences (bonuses/pending bets).

4. 10 IP and Content

All rights to the Software/content are with the operator/licensors; limited use license.
Ban on reverse engineering, framing, copying content.

4. 11 Privacy, cookies and marketing

A brief reference to the Privacy Policy and the Cookie Policy;

Marketing Consent Management; right to withdraw at any time.

4. 12 Liability, warranties, force majeure

The platform is provided "as is"; limitations of liability within the law; there is no guarantee of continuous operation.
Force majeure events: service interruptions, wars, sanctions, force majeure providers.

4. 13 Disputes, Law and Language

Claim procedure; response time (e.g. 14-30 days).
ADR/mediation/arbitration (if applicable); indicate the ADR body.
Applicable Law and Court/Arbitration; The priority of the language version (for example, English) for discrepancies.

4. 14 Condition Changes

Notification procedure (internal notification + email), "last update date," re-consent requirement for material changes; the ability to close your account before changes take effect.

5) UX consent patterns (no "dark" practices)

The consent checkbox is not preinstalled; there is a brief squeeze and a reference triad: ToU/Privacy/Bonus T & C.
Inside onboarding is a "layer" with key risks: age, geo, responsible play, KYC/withdrawals.
History of ToU versions in the profile with acceptance date and IP/device (WORM log).

6) Regional nuances (high-level)

EU/EEA: emphasis on GDPR/consent, rights of subjects, ADRs; transparency of bonuses/vager.
UK: UKGC practices - understandable T & Cs, prohibition of misleading bonuses, disputes through ADRs.
Canada/provinces: distinction between Crown operators and private; local advertising rules.
US (states): different permits/bans, local RNG/house rules, payments/void.
Brazil/LatAm: transfers and local payment channels, tax/deduction clarity.

8) Closing and deduction policies

Blockage conditions in case of fraud/sanctions; order of appeal and timing.
Rules of deductions/confiscations only on the basis of proven violations and in the amount of winnings/bonus abuse; WORM-journal and reason-codes; right to independent review.

12) Versioning and notifications

Version and date on the first page; Change History page.
Significant changes → explicit re-consent; insignificant - notice and continued use = acceptance.
Effective date: not earlier than N days from notification (except for legal/safety requirements).

13) Frequent mistakes and how to avoid them

Mix ToU and bonus rules → keep a separate document with priority.
Hidden commissions/terms → tables and examples of calculations in a clear form.
No ADR/complaint channel → increases regulatory risks.
Opaque palpable error → write criteria and procedure in advance.
There is no version journal → it is impossible to prove consent to a specific edition.
