South Korea - regime and exceptions
General characteristics of the mode
South Korea is one of Asia's strictest gambling jurisdictions. The Criminal Act, arts. 246-247, prohibits both organizing and participating in gambling.
The ban also applies to online games, regardless of their location. Any citizen playing in a foreign online casino can be prosecuted, even if the site is legal abroad.
Basic Laws and Regulatory Bodies
Criminal Act (s 246-247): Basic gambling ban.
Tourism Promotion Act: Establishes permitted forms of casino activity for tourists.
National Gambling Control Commission (NGCC): Oversight and coordination of all legal forms of gambling, including lotteries, sports and casinos.
Ministry of Culture, Sports and Tourism (MCST): issuing licenses and managing the IR (Integrated Resort) system.
Exceptions to general prohibition
1. Kangwon Land Casino
The only casino where South Korean citizens are allowed to play. Located in the mountainous region of Gangwon Province, managed by Kangwon Land Inc.
It was founded in 2000 to stimulate the economy of the coal region.
Strict attendance control: a maximum of 15 visits per month, an identification system, cameras, a ban on entering persons with debts.
The main audience is local players; for all other casinos in the country - access only to foreigners.
2. Casino for foreigners
There are about 15 licensed casinos in the country (Seven Luck, Paradise, Grand Korea Leisure, etc.), where South Korean citizens are not allowed.
Clientele - exclusively foreigners (passport entry).
Compliance with the regime is monitored by the NGCC and the Ministry of Internal Affairs.
Operators are required to comply with KYC, RG and reporting rules as part of the Tourism Promotion Act.
3. State forms of legal games
Lottery (Lotto, 6/45) - under the control of the Korea Lottery Commission.
Horse, dog and bicycle racing betting - regulated by Korea Racing Authority and local authorities.
Sports Toto and Proto are legal sports betting overseen by the Korea Sports Promotion Foundation.
Each form has a separate license and limited sales channels (official sites, terminals, agents).
Online Gambling
Total ban
Online casinos, poker, slots, bingo, as well as betting outside the official platforms (Lotto, Sports Toto) are prohibited.
The authorities are actively cooperating with Internet providers to block domains and IP addresses of offshore operators.
The banking system is obliged to block transactions related to gambling sites.
Responsibility
Participation in illegal online games: a fine of up to 10 million won or imprisonment of up to 3 years.
Organizing games or making a profit from them - up to 7 years in prison.
Since 2024, a register of offshore domains has been introduced, blocked at the request of the prosecutor's office.
Integrated Resort (IR) Policy
South Korea views IR as a tourism tool, not a legalization of gambling.
The IR model (e.g. Paradise City in Incheon) combines casinos for foreigners, hotels, congress centers, museums, entertainment complexes.
The casino area is strictly segregated and controlled; residents are not allowed to enter.
IR operators are required to comply with RG measures, reporting and annual NGCC audits.
Control and critical games system
The Responsible Gambling Center (RGC) program implements consultation, access restriction and self-locking.
From 2023, the NGCC introduced a single digital ID to limit visits and track players.
The treasury industry is obliged to annually allocate a share of income (up to 1%) to the fund for the prevention of addiction.
Risks and trends
Hard blocking of online games: offshore sites are actively filtered, payment gateways are monitored.
Growing interest in the IR model: the government supports projects focused on foreign tourism.
Social emphasis: maintaining strict barriers for citizens while maintaining income from foreigners.
Technology oversight: NGCC is developing an analytical system for monitoring rates and visits to identify violations.
Output
South Korea follows a policy of severely restricting gambling for citizens and allows only limited forms under state control.
Online casinos, offshore betting and crypto platforms remain outlawed.
The IR model, by contrast, develops the tourism sector while maintaining full state control over social risks.
