In August 2025, the project was approved in general by the Senate and continued to be considered in the second constitutional trámite. Before the law comes into force, the courts confirm the illegality of the activities of unauthorized online bookmakers, and the authorities are seeking to block sites.

Project status and objectives

Status (as of November 2, 2025): The Senate approved the draft in its general form on August 13, 2025; the document passes the second trámite with a focus on economics, taxation and compatibility with other anti-crime initiatives. Previously, the project received support in commissions and in the Chamber (2023).
Goals: protecting the player and public interests, creating a competitive and transparent market (along with already legal forms - lotteries, casinos, hippies), strengthening RG and increasing budget revenues.

Regulatory Architecture

The Ministry of Finance (Hacienda) - the initiator of the fiscal circuit, presented key parameters (20% specific tax; 2% for sports).
SCJ (Superintendencia de Casinos de Juego) - supposed operational oversight: register of authorized platforms, monitoring compliance, as well as powers to block domains and payment channels in relation to illegal operators. The SCJ has publicly confirmed the expectation of new powers.
Courts - affirm the illegality of online betting without permission (Chilean Supreme Court decision of 12. 09. 2023; subsequent blocking of illegal sites).

Licensing and Tolerance Perimeter (Draft)

Platform authorization: access will be given to legal entities that meet the requirements for transparency of ownership, integrity of beneficiaries, technical/cyber readiness, RG and AML. Maintaining the register of authorized persons is for SCJ.
Covered products: online casinos (RNG, live), fixed sports betting, virtual and other permitted games - with standards of randomness/honesty and RTP/probability disclosure (detail is fixed by SCJ bylaws).
Market access: existing land-based casinos can request online authorization through separate structures, subject to project requirements.

Taxes, Contributions and Distributions (Draft)

A specific tax of 20% - by analogy with land casinos to correct external effects; + 1 pp is additionally provided with the possibility of offsetting documented expenses for RG events (wording of the Ministry of Finance).
Annual contribution of 2% of gross income from sports betting - in favor of the Instituto Nacional del Deporte (distribution between federations, NOC and Paralympic Committee); in parallel, the fiscal regime of the Xperto product (state provider) is leveled.
Other taxes - general regimes (IVA/income) and supervisory fees may supplement the fiscal basket; specified in the secondary regulation.

Advertising, Responsible Gaming and Consumer Protection

Advertising: prohibition of misleading communication, restrictions on the coverage of minors/vulnerable groups; joint responsibility of the operator for affiliates. Specific restrictions and formats are in by-laws.
Responsible Gaming (RG): requirements for self-exclusion, limits, visible warnings; mandatory publication of house rules and fair bonus/share terms.
Age: strict 18 +, KYC checks at registration/payments.

Countering the illegal market

Blocking: according to the project, SCJ will receive advanced tools to block URLs and block payment channels of illegal sites; previously, the Supreme Court has already upheld the blockages.
Public position: acting. cl-platforms are declared illegal without permission; The committees and the Ministry of Finance consistently fix this line.

Technical standards and compliance (framework)

Platform and games: RNG/content certification; version control (signatures/hashes), unchangeable logs, SDLC/Dev→Prod; log storage and availability for SCJ.
Cyber/data: MFA/IAM, vulnerabilities/patches, SIEM/logging, DR/BCP; protection of personal data in accordance with the national regime.
Sports Integrites: external data/alert providers, trading journal, prohibition of insider participation; audit of calculations/cancellations.

Exit roadmap (standard for the law)

1. Pre-filing (0-2 months) - local structure (legal entity), map of beneficiaries/sources of funds, GAP analysis of SCJ/Hacienda project requirements; drafts by RG/AML/InfoSec and house rules.
2. Application (2-4 months) - suitability dossier (company/beneficiaries/key personnel), technical package (RNG/games, payments, geo-filter, logs), financial model with 20% specific tax and 2% sports contribution.
3. Certification and pilots (3-6 months) - laboratory tests, integration with SCJ reporting, setting up RG modules/self-exclusion, marketing audit.
4. Authorization and launch (5-7 months) - inclusion in the SCJ register, launch with monitoring, monthly reports and payment of taxes/contributions; control of affiliates and payment channels.

💡 Time windows and specific forms/rates are finally fixed after the adoption of the law and the publication of SCJ/Ministry of Finance by-laws.

We will squeeze the illegal segment: strengthening the authority of SCJ to block URL/payments and public communication about the illegality of unauthorized platforms.
Equalization of competition conditions with staats products (for example, Xperto) by tax burden and payout.
Increase in RG requirements/transparency of bonuses, standardization of technical circuits and magazines.

What's important to remember

Chile's online gaming bill is the second trámite and approved generally by the Senate (August-2025). It introduces the SCJ registry, a 20% specific tax, and a 2% sports betting fee, tightens RG/advertising, and gives the regulator tools to block URLs and illegal payments. Until the law is finally adopted, online bets without authorization are considered illegal, which is confirmed by judicial practice.
